Fix the Court Gears Up for Second Financial Disclosure Deadline

The Courthouse Ethics and Transparency Act that President Biden signed in 2022 means two things for judges’ and justices’ financial disclosure reports:

First, they all have to be posted online. Second, they all have to be posted online by date certain. Well, dates.

The filing deadline is May 15 each year for the prior year’s disclosure. So on May 15, 2026, jurists’ 2025 disclosures were due to the Administrative Office of the U.S. Courts.

CETA requires the AO to post all the disclosures within 90 days of the deadline, which is Aug. 13.

But jurists are permitted a one-time 90-day extension (p. 12). So that means the second posting deadline is Nov. 11.

Ahead of that, Fix the Court is compiling a list of all the circuit court judges in the country and tracking whether their disclosures are posted. It’s our belief that 99% of these disclosures have been filed, and it’s the AO that’s being slow in posting them.

Overall — that is, including district, magistrate and bankruptcy judges — only 2,000 of the 2,400 disclosures that judges filed in 2025 were posted in the database as of yesterday afternoon.

Even if a judge requests that some information in the disclosures be redacted for security purposes — which, assuming a judge fills out their disclosures form properly and doesn’t volunteer extra personally identifiable information (you’d be surprised how often it happens), applies to less than five percent of judges — there’s no reason the U.S. Marshals, the AO and the Judicial Conference’s Committee on Financial Disclosure can’t do the redacting within the six-month period between May and November. It shouldn’t take that long, and it definitely shouldn’t take longer.

One of the judges who’s missing all her disclosures (not just 2025 but 2021-2025) is going through a divorce. Another one cannot seem to treat her clerks properly. A few are on SCOTUS shortlists. Is there any connection here? We’re not sure.

But we’ll start to name and shame next week.
