FTC on Independent Redistricting Case: Why Not an "Independent SCOTUS Nominating Commission"?
Fix the Court executive director Gabe Roth issued this statement following the release of the Supreme Court’s opinion in Harris v. Arizona Independent Redistricting Commission:
There is an apt parallel between today’s unanimous decision upholding Arizona’s use of an Independent Redistricting Commission and the ongoing high court vacancy – that it is, in fact, possible to make difficult decisions about law and policy and who holds which position via a nonpartisan or bipartisan body of experts.
If the Supreme Court confirmation process included an ‘independent judicial nominating commission’ that could put forward a nominee that had the backing of both parties, then it is possible the third branch would be at full strength right now and would be not be used as a political football by Senate Republicans and Democrats alike.
