Justice Thomas Violated Disclosure Laws, Per New Senate Judiciary Report

Following the release of a comprehensive report — “An Investigation of the Ethics Challenge at the Supreme Court” — by Senate Judiciary Committee staff that details the numerous ethics violations of Justice Thomas and his SCOTUS colleagues, Fix the Court executive director Gabe Roth issued this statement:

“The Majority Staff Report is not merely the Thomas Report, though he plays the most prominent role. It shows how nearly every justice — liberal and conservative, both those who’ve left the Court in the recent past and the nine who serve today — has made lapses in judgment when it comes to their ethical responsibilities.

“Yes, there’s no peer to Thomas (besides, maybe, Scalia), but the others do not get off scot-free.

“The sad part is there are nonpartisan solutions to fix the gaps in ethical oversight  — a judiciary inspector general, like Sen. Chuck Grassley proposed as recently as 2017, and a ban on gifts, which polls well in both parties, jump out — but there’s little chance these will be acted upon when Congress returns in January.

“Real accountability may not occur until the worst offenders leave the Court, which, given the turnover in the Senate and the White House, could happen as soon as next year.”
