Alito Teases the Era of "You Can’t Make Us"
In an op-ed for Bloomberg Law, FTC’s Gabe Roth responds to Justice Alito’s July 28 interview with the Wall Street Journal, in which the justice said, “No provision in the Constitution gives [Congress] the authority to regulate the Supreme Court—period.”
That clearly erroneous statement, Roth writes, is not only a warning shot against legislation the Senate is currently considering on SCOTUS ethics, but it also serves to encourage lawsuits aimed at overturning the financial disclosure law the justices follow.
Depressing as that sounds, it’s better to be clear-eyed about the prospects of a Court that’s even less accountable than it is now than look back with regrets in hindsight.
