As SCOTUS Debates Path Forward on Broadcast, Vast Majority of State Supreme Courts Continue to Livestream

Earlier this week, the U.S. Supreme heard its final oral arguments of OT20, the audio of which was livestreamed to the public. There’s no guarantee, though, that livestreams will return when the justices reconvene on the first Monday in October.

For comparison’s sake, we’ve been tracking how other federal appeals courts and state courts of last resort are doing on broadcast, with our findings from the states below. In short: 41 of 50 courts are livestreaming video, up from 35 last year. And 47 states are doing some form of livestreaming, up from 43 last year.

At the bottom of this post are stats from the last time we checked in on the states, which was last June.

Stats as of June 24, 2020

Remote live video (35 states): Alaska, Arkansas, Arizona, California, Colorado, Florida, Georgia, Hawaii, Idaho, Illinois, Indiana, Kansas, Kentucky, Louisiana, Maine, Maryland, Michigan (screenshot above), Minnesota, Nebraska, Nevada, New Hampshire, New Jersey, New Mexico, New York, North Carolina, Ohio, Oregon, Pennsylvania, South Carolina, Tennessee, Texas, Vermont, Washington, West Virginia, Wisconsin

Remote live audio (8): Massachusetts, Missouri, North Dakota, Rhode Island, South Dakota, Utah, Virginia, Wyoming

Total livestreaming: 43 states

Remote delayed audio (1): Connecticut

Other situations (6): the Montana Supreme Court skipped remote hearings altogether and conducted oral arguments in person beginning on May 20. Top courts in the other five – Alabama, Delaware, Iowa, Mississippi and Oklahoma – have canceled arguments altogether, though that was a bit odd since Delaware, Montana, Iowa and Mississippi do typically video-record oral arguments.
