President Trump has chosen D.C. Circuit Judge Brett Kavanaugh (right) as his nominee to the Supreme Court to replace Justice Anthony Kennedy

As a nonpartisan watchdog keeping its pulse on how the public views the high court, Fix the Court recently asked Americans their thoughts on the next justice and on the types of cases he or she may wish to see back on the docket.

Here are the results:
– 83% want him to uphold Brown v. Board, on school desegregation, vs. 14% oppose
– 75% want him to uphold D.C. v. Heller, on gun ownership rights, vs. 22% oppose
– 71% want him to uphold Roe v. Wade, on abortion rights, vs. 25% oppose
– 55% want him to uphold Obergefell v. Hodges, on same-sex marriage, v. 40% oppose
– 54% support the Colorado Civil Rights Commission in Masterpiece Cakeshop, vs. 37% oppose

In terms of what qualities Americans deem important in a nominee, only 34% say loyalty to Trump is important to them, but a majority (62%) says that loyalty to the president is important in Trump’s own calculations.

Further, 59% say there should be a 60-vote requirement in the Senate to confirm a justice, while only 30% say 51 votes is acceptable in order to prevent the minority party from holding up nominations.

And 68% of Americans say we should abolish the practice of lifetime appointments for justices and instead allow them to serve only a fixed term, vs. 26% opposed. (The numbers on this are 77%-20% for Rs and 59%-31% for Ds.)

Global Strategy Group and Public Opinion Strategies conducted a survey of 1,028 registered voters nationwide from May 16-22, 2018, on behalf of Fix the Court. The margin of error at the 95% confidence level is +/- 3.1%. The margin of error on sub-samples is greater.
