Statement on Second Circuit's Denial of Video Coverage

Fix the Court executive director Gabe Roth issued the following statement following word that the Second Circuit Court of Appeals has denied C-SPAN’s video coverage request for tomorrow afternoon’s Zarda v. Altitude Express:

Though there may seem to be certain technical challenges to recording an en banc hearing that do not present themselves with a three-judge panel, there is a simple fix: a wider shot.

Just last week the Ninth Circuit video-recorded an en banc hearing with no difficulties, and the appeals courts that either allow video or are seriously considering it – that’s the Second, Third and Seventh Circuits – could learn from their example.

As Title VII cases are receiving heightened public attention here in New York and across the country, court staff should accommodate that interest with broadcast access.
