Chicago Tribune: Supreme Court Justices Are Not Immune to the News

In the Chicago Tribune, Harvard Law Prof. Noah Feldman discusses the extent to which Supreme Court justices pay attention to the day’s headlines, especially when those headlines relate to issues before them, like affirmative action on college campuses and bans on assault weapons.

It’s an interesting (and open) question, as most people tend to want the justices to simultaneously – and maybe paradoxically – follow the 18th century Constitution while at the same time understanding present day, 21st century exigencies.
